Ili nije postojao. U oba slu\u010daja, posledice se mere mesecima \u010dekanja, izgubljenim depozitom ili stanom iz kojeg ne mo\u017eete da isterate stanara koji ne pla\u0107a. Evo koje stavke \u010dine razliku izme\u0111u papira i pravne za\u0161tite.<\/p>\n\n\n\n<p>Ime, prezime i JMBG obe strane, adrese stalnog boravi\u0161ta. Ako <a href=\"https:\/\/www.nekretnine.rs\/stambeni-objekti\/stanovi\/izdavanje-prodaja\/izdavanje\/lista\/po-stranici\/10\/\">stan izdaje<\/a> firma, onda su potrebni naziv i PIB.<strong> Ovo nije formalnost: bez ta\u010dnih li\u010dnih podataka ugovor ne mo\u017ee biti osnov ni za jednu pravnu radnju.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Precizni podaci o stanu<\/h2>\n\n\n\n<p>Adresa, sprat, kvadratura, broj soba, katastarska parcela. Uz ugovor ide i broj lista nepokretnosti, jedini dokaz da zakupodavac zaista ima pravo da stan iznajmi. Standardno je jedna do dve <a href=\"https:\/\/www.nekretnine.rs\/news\/analiza-trzista-nekretnina\/izvestaji-o-nekretninama\/kirije-u-srbiji-2026-konacno-u-padu-dok-cene-stanova-nastavljaju-da-rastu-evo-sta-to-znaci-za-podstanare-22691\/\">mese\u010dne kirije.<\/a> <strong>Sporovi oko depozita ubedljivo su naj\u010de\u0161\u0107i razlog tu\u017ebi izme\u0111u stanara i vlasnika u Srbiji.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Trajanje zakupa i raskid<\/h2>\n\n\n\n<p>Datum po\u010detka, datum isteka ili otkazni rok. Z<strong>a ugovore na neodre\u0111eno vreme zakonski minimum je 30 dana<\/strong>. Posebno treba definisati prevremeni raskid <a href=\"https:\/\/www.nekretnine.rs\/news\/zivot-u\/beograd\/stanovi-do-400-evra-u-beogradu-gde-ih-jos-ima-i-sta-realno-mozete-ocekivati-22688\/\">ugovora o zakupu stana &#8211;<\/a> ko mo\u017ee, pod kojim uslovima, u kom roku<strong>. Ovo obe strane redovno preska\u010du, i to ih ko\u0161ta.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Tro\u0161kovi i re\u017eije<\/h2>\n\n\n\n<p>Ko pla\u0107a struju, vodu, grejanje, internet, upravljanje zgradom. <strong>Naj\u010de\u0161\u0107i model: stanar pokriva potro\u0161nju, vlasnik fiksne tro\u0161kove uklju\u010duju\u0107i porez na imovinu.<\/strong> Svaki druga\u010diji dogovor mora biti eksplicitno napisan &#8211; <a href=\"https:\/\/www.nekretnine.rs\/news\/trziste-nekretnina\/stanovi-i-kuce\/imate-20-minuta-da-spasite-novcanik-sta-obavezno-proveriti-pre-nego-sto-iznajmite-stan-22690\/\">to morate da proverite i utvrdite.<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Popis inventara<\/h2>\n\n\n\n<p>Prilog ugovoru sa name\u0161tajem i opremom, opisom stanja svake stavke. Fotografije unutra\u0161njosti s<a href=\"https:\/\/www.nekretnine.rs\/news\/analiza-trzista-nekretnina\/izvestaji-o-nekretninama\/kolike-su-danas-kirije-u-srbiji-beograd-preko-1-000-evra-unutrasnjost-oko-200-22683\/\">tana koji se izdaje<\/a> uz popis nisu obavezne, ali su pametne. Iseljavanja bez ovog dokumenta gotovo redovno zavr\u0161e u sva\u0111i.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Namena i zabrane<\/h2>\n\n\n\n<p>Ku\u0107ni ljubimci, pu\u0161enje, podzakup sve \u0161to nije dozvoljeno mora biti napisano. Verbalni dogovor o<a href=\"https:\/\/www.nekretnine.rs\/news\/zivot-u\/beograd\/kirije-u-beogradu-od-200-do-2-500-evra-razlike-izmedju-opstina-sve-vece-22685\/\"> zakupu stana<\/a> pred sudom ne zna\u010di ni\u0161ta.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Overa kod javnog bele\u017enika<\/h2>\n\n\n\n<p>Neoveren ugovor nije izvr\u0161na isprava. U slu\u010daju nepla\u0107anja kirije, vlasnik mora da pokrene sudski postupak koji traje mesecima. <strong>Overen ugovor omogu\u0107ava direktnu izvr\u0161nost bez su\u0111enja. Naknada za overu je simboli\u010dna u odnosu na tu razliku.<\/strong><\/p>\n\n\n\n<p>Zakup nepokretnosti u Srbiji reguli\u0161u Zakon o obligacionim odnosima i Zakon o stanovanju. <strong>Svaki ugovor koji izostavlja neku od navedenih stavki ostavlja jednu od strana bez za\u0161tite naj\u010de\u0161\u0107e onu koja je mislila da je sve jasno i bez toga.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Svaki spor izme\u0111u stanara i vlasnika po\u010dinje na istom mestu, ugovorom koji nije bio dovoljno precizan.
